Under Thai land laws ownership of land in Thailand is not open to foreigners (this is not different in Isaan). Foreigners can also not claim any form of use or possession over untitled land (e.g. farmland); however, expatriates/ foreign investors may invest in certain real estate properties and have contractual legal structures available to protect their interest in titled land and/or buildings in Thailand for a period of time.

A common structure is a loan agreement and a right of usufruct or registered long term lease, whereby payment of interest on the loan is set off against the payment of rent, or in case of a marriage with a Thai national a right of usufruct without consideration.

Thai Usufruct agreement: the land offices in Thailand offer a free standard Thai script usufruct agreement form to be registered on the property deed. We offer a more comprehensive Thai-English usufruct agreement drafted by a Thai lawyer. The usufruct agreement is signed in the presence of two witnesses and an endorsement of the usufruct is registered against the land title deed.

Thai condominium apartments and foreign ownership
